1. Purpose

ENT Quest ("the Application") is a professional tool that provides validated clinical questionnaires in the fields of Otorhinolaryngology, Otoneurology and Head & Neck Oncology. The Application is intended exclusively for healthcare professionals and for their patients when the latter are invited to complete questionnaires through a link supplied by their doctor. Using the Application implies full and unreserved acceptance of these Terms.

2. Ownership

The Application is owned and operated by Juan Pablo García Arteaga, ENT physician, Spanish medical licence nº 212105263, with professional address in Huelva, España.

3. Account registration

  • Accounts are reserved for licensed healthcare professionals or those in accredited clinical training.
  • Users must supply truthful information and keep their credentials confidential.
  • Users are responsible for any use made through their account and must promptly report any unauthorised access.

4. Acceptable use

Users agree to use the Application in accordance with the law, good faith and public order. In particular, the following are prohibited:

  • Using the Application for fraudulent or unlawful purposes.
  • Entering identifying patient data (full name, national ID, phone, address).
  • Attempting to access other users' accounts, data or systems, or reverse-engineering the code.
  • Publicly sharing patient links (QR codes) outside the clinical context for which they are issued.

5. Medical disclaimer

The Application provides decision-support tools for clinical practice. Scores and their interpretations are indicative only and do not replace the clinical judgement of the healthcare professional, in-person examination or the appropriate diagnostic tests. The therapeutic decision and final diagnosis are the sole responsibility of the professional attending the patient. ENT Quest does not establish a doctor-patient relationship with any user of the Application.

6. Intellectual property

The Application, its code, designs, trade marks and original content are protected under the applicable intellectual and industrial property regulations. The clinical questionnaires included (SNOT-22, EAT-10, DHI-25, THI-25, ETDQ-7, VHI-30 and any others) are instruments published by their original authors and are offered here as reference tools for professional use. Responsibility for their clinical application and for compliance with each instrument's licence lies with the professional user.

7. Availability

Reasonable efforts are made to keep the Application available and up to date, but continuous availability and error-free operation are not guaranteed. Maintenance, changes or service interruptions may occur, with care to minimise user impact.

8. Limitation of liability

To the maximum extent permitted by applicable law, ENT Quest is not liable for indirect damages, loss of profit, loss of data, or clinical decisions taken in whole or in part on the basis of information shown by the Application. Clinical responsibility rests at all times with the healthcare professional.

10. Data Processing Agreement (Art. 28 GDPR)

When the professional user uses the Application to receive, store or manage patient questionnaire answers (including any short labels the doctor may attach to those records), ENT Quest acts as Data Processor on behalf of the doctor, who is the Controller. Acceptance of these Terms constitutes the data processing agreement between the doctor and ENT Quest for the purposes of Art. 28 GDPR.

  • Subject-matter and duration. Providing the service of collecting, scoring, storing and consulting patient answers for as long as the doctor's account remains active.
  • Nature and purpose. Processing on behalf of the Controller, solely to provide the service described. ENT Quest will not use such data for its own purposes, nor for advertising, profiling, transfer to third parties or training of artificial-intelligence models.
  • Type of data and data subjects. Answers to clinical questionnaires, computed score, timestamp and, where applicable, a pseudonymised label entered by the doctor. Data subjects: the Controller doctor's patients.
  • Doctor / Controller obligations. Obtain the appropriate legal basis (typically explicit consent under Arts. 6.1.a and 9.2.a GDPR or the provision of healthcare under Art. 9.2.h GDPR) and inform the patient in the consultation; avoid entering direct identifying data (full name, national ID, phone, address or email) in the label; handle data-subject rights; and use the Application in accordance with applicable law.
  • ENT Quest / Processor obligations. Process data only on the documented instructions of the Controller (which include those arising from the normal use of the Application); ensure confidentiality of authorised personnel; apply appropriate technical and organisational measures (encryption in transit, access control, environment separation, activity logging); assist the Controller, insofar as possible, in responding to data-subject rights and in complying with security and breach notification obligations (Arts. 32–36 GDPR); and notify security breaches without undue delay upon becoming aware of them.
  • Sub-processors. The Controller authorises ENT Quest to engage infrastructure and transactional email providers to deliver the service (e.g. database, authentication, cloud hosting and email-sending services), engaged with the guarantees of Art. 28 GDPR. Where the service involves international transfers, the Standard Contractual Clauses approved by the European Commission or another valid mechanism will apply.
  • Return and deletion. On termination of the service, ENT Quest will delete or return to the Controller, at the Controller's choice, all personal data processed on the Controller's behalf, together with any copies, unless a legal retention obligation applies. The Controller may at any time delete individual records from their inbox or request account cancellation and deletion of all associated responses by writing to jgarciaarteaga.md@gmail.com.

11. Termination

Users may request the deletion of their account and associated responses at any time by writing to jgarciaarteaga.md@gmail.com. ENT Quest may suspend or terminate accounts that breach these Terms or put the integrity of the service at risk.

12. Governing law

These Terms are governed by Spanish law. Any dispute arising from their interpretation or performance shall be submitted to the Courts of the user's domicile when so required by applicable consumer regulations, and otherwise to those of the operator's domicile (Huelva, España).
